This dataset was created as published December 8, 2020, as an aid to CDFW, the State Water Resources Control Board, and the public following the enactment of Senate Bill 637 in 2015. (Stats. 2015, ch. 680, 1-4.) The dataset is a representation of the Class A year-round and Class B through H seasonal restrictions set forth in section 228.5 of Title 14 of the California Code of Regulations. This regulation governs the use of vacuum or suction dredge equipment in California under the Fish and Game Code, effective April 27, 2012. (2012 Cal. Reg. Notice Register, No. 19-Z, p. 641 (May 11, 2012).) Notwithstanding the regulation, the use of vacuum or suction dredge equipment as defined is currently prohibited by statute in all California rivers, streams, and lakes. (Fish and G. Code, 5653.1, subd. (b); see also Id., 5653, subd. (g) (definition).) It is also unlawful under current law to possess a vacuum or suction dredge in areas, or in or within 100 yards of waters, that are closed to the use of such equipment. (Id., 5653, subd. (e).) This dataset is an approximate depiction of the Class closures and restrictions in California Code of Regulations, Title 14, section 228.5. Members of the public considering the use of vacuum or suction dredge equipment are responsible for knowing the exact regulation language that applies to any specific location in California. For current information regarding the lawful use of vacuum or suction dredge equipment in California please see Here
<purpose>The purpose of this dataset as of the date of publication is to provide a mapped representation of the California Department of Fish and Wildlife (CDFW) regulation setting forth the year-round and seasonal restrictions by “Class” governing the use of vacuum or suction dredge equipment in California rivers, streams, and lakes. Boundaries shown are approximate. Members of the public considering the use of vacuum or suction dredge equipment are responsible for knowing the exact regulation language that applies to any specific location in California. Importantly, the use of vacuum or suction dredge equipment as defined is currently prohibited by statute in California. (Fish and G. Code, 5653.1, subd. (b); see also Id., 5653, subd. (g)(definition).)</purpose>
